At BWB Mediations we help you move forward without the expense and stress of court. Mediation gives you a chance to have open, guided conversations in a safe space, where both sides can be heard. With the help of a neutral mediator, you’ll explore options and work toward a fair, practical solution that works for everyone—especially when children are involved. Our goal is to help you find clarity, resolution, and a better path forward.
Our Mediation Services
Parenting mediation helps you resolve disagreements about your children’s care and well-being without going to court. This may include decisions about where the children live, how much time they spend with each parent, schooling, medical care, financial support, and how important information is shared between parents. Mediation provides a structured, neutral space to discuss these issues and find solutions that prioritize the best interests of your children. The goal is to create a practical and cooperative parenting arrangement that works for everyone, reducing conflict and promoting stability for the children.
When a relationship ends, dividing assets and liabilities can be challenging. Property mediation helps you reach a fair agreement on how to split real estate, businesses, trusts, cars, personal belongings, shares and other assets (and liabilities). Instead of going to court, mediation provides a neutral and structured space to negotiate a clear and practical division, ensuring both people understand who keeps what and how the process will unfold. The focus is on achieving a fair and sustainable outcome that allows each of you to move forward with financial stability and certainty.
If a parenting mediation is unsuccessful or the other person refuses to participate, you will need a Section 60I Certificate to apply to the court. This certificate confirms that mediation was attempted but did not resolve all issues, did not proceed or was deemed unsuitable. Only accredited Family Dispute Resolution Practitioners (FDRPs) can issue this certificate. Our FDRPs can assess your situation, facilitate mediation, and provide the necessary certificate if required. Whether mediation was attempted, declined, or determined inappropriate, we ensure you have what you need to take the next steps in your parenting dispute.

Which Type of Mediation Do You Need?
You can attend mediation with or without a lawyer
You don’t need to have a lawyer to attend mediation. Our role as mediators is to help guide productive discussions and support you in finding a resolution that works for everyone. While we can’t provide legal advice, we can absolutely assist you in working through the issues, even if neither you nor your spouse has a lawyer.
If you prefer, you’re also welcome to bring a lawyer to mediation. They can provide legal advice, support you through negotiations, and help you navigate the process with confidence.
The choice is entirely yours—whether you attend mediation on your own or with a lawyer, we’re here to help you every step of the way.
Mediation can take different formats, and we tailor the approach to suit your needs. The most common option is shuttle mediation, where each person is in a separate room (either in person or online), and the mediator moves between you, sharing information and proposals.
Alternatively, you may prefer joint mediation, where everyone is in the same room, allowing for direct discussions, with the mediator’s guidance.
The best format depends on your preferences, the issues being discussed, and what feels most comfortable for everyone involved. If there’s no agreement on the format, the mediator will decide on the best approach to ensure a productive and constructive process.
FAQs
Mediation gives you a chance to talk through any family law issues in dispute with the help of a qualified mediator. You don’t have to be in the same room as the other person, but you do need to be ready to communicate your concerns and explore possible solutions. Both of you will have the opportunity to share your concerns, discuss your needs, and suggest ways to move forward. If you reach an agreement, it can be formalised - hopefully resolving the dispute so you can move on.
Mediation can help anyone involved in a family law dispute. This includes parents, grandparents, or others who play a role in a child’s life. For property disputes, mediation is available for married or de facto couples who need to reach a property settlement. Sometimes third parties might also be involved, such as people who have an interest in property which is the subject of a property settlement between two other people ie a house is owned by two separating people, together with someone else, perhaps a parent or similar.
No, you don’t have to be in the same room unless you’re comfortable with it. Mediation can happen in person with both of you together, or through a "shuttle" process where you’re in separate rooms and the mediator moves between you. Another option is video mediation, where you may or may not be in the same virtual room—again, only if you’re comfortable with it.
It depends on the issues being discussed and how prepared both people are. If the issues are straightforward, mediation might only take half a day. More complex matters can take a full day or longer. If needed, a second session can be scheduled to address any unresolved issues. However, for most families, one day is usually enough.
Yes, mediation is voluntary, and you can choose not to attend. However, refusing mediation may have consequences if the other person applies to the court. In parenting matters, the mediator can issue a certificate stating that mediation didn’t proceed because one party declined to participate (referred to as a section 60i certificate). If you’re considering refusing mediation, it’s a good idea to get legal advice to understand the potential impact.
It depends on the issues in dispute. If no agreement is reached, you may need to go to court, where a judge will decide on parenting arrangements or how property should be divided. This is often not the preferred option, as court proceedings can be costly, time-consuming, and unpredictable.
No. You can attend mediation without a lawyer, which is what we call self-represented. However it is important to know that the mediator cannot provide legal advice. It may be that you have access to a lawyer who you can contact by phone during the mediation, to get advice if needed. Otherwise you are strongly encouraged to get some legal advice prior to attending mediation, however there is no issue with you attending without a legal representative.
Whether or not you can bring a support person will be decided by the mediator. If you feel that you would be assisted by bringing a support person, please advise the mediator of this at least 5 days prior to the mediation, including who you would like to bring. The mediator may contact you to discuss this prior to the mediation. The role of the support person is not to speak or make decisions on your behalf, however to provide you with emotional support throughout the mediation. It is important to consider who might be best placed to do this, if you feel like you may benefit from having someone attend with you.

Half day mediation 4 hours - $1,500
Full day mediation 8 hours - $2,750
We can conduct mediations at a venue of your choice, or online. We also provide mediation rooms free of charge in Toowoomba.
